Court orders rearrest of elderly man accused of molesting a minor granted conditional release

High Court has overturned a decision by a lower court to release an elderly man accused of molesting a nine-year-old, ordering the lower court to review its decision.

The apex court reached the decision on Tuesday with the unanimous consensus of the judges presiding over the case.

As the case involves a minor, the hearings were held behind closed doors. The lower court that ordered the release of the elderly man is also classified.

According to the case report, the defendant in the case is an elderly man above 60 who was remanded in custody pending the outcome of his trial. The lower court reviewed his remand and ordered his release in consideration of his health condition.

According to the man, he suffers from various health conditions, including kidney disease, thyroid disease, arthritis, mental health issues and heart disease. The man said he was arrested shortly after doctors instructed him to undergo screening for cancer.

As per the case report, the man was arrested under a court order on January 14th, and charged with touching a minor with sexual intentions on March 9th. He was remanded in custody pending the outcome of his trial on March 14th.

The lower court had granted the man conditional release at his request for home confinement. The state appealed the decision with the High Court, seeking his rearrest.

High Court overturned the lower court’s decision, ordering the lower court to review his remand if resubmitted to the court within five days.
