Chief Justice Ahmed Faiz Hussain has said that the case on the legitimacy of the Hulhumale’ Court was not dealt with until now because it was not filed to the Supreme Court by the Judicial Service Commission (JSC).
Faiz said this while talking to reporters today after the opening ceremony of the Drug Court.
Responding to a question, Faiz explained that when lawyer Ismail Visham filed the case questioning the legitimacy of the Hulhumale’ Court to Civil Court about a year ago, the JSC sent a letter to the Supreme Court saying that the case was not within the jurisdiction of the Civil Court.
Following this letter, the Supreme Court ordered Civil Court to defer action on the case.
Faiz said that when JSC sent the letter, the Supreme Court informed JSC to file the case according to procedures; however, JSC formally filed the case ‘only a few days ago’.
He said that the Supreme Court had decided to prioritise this case.
Proceedings at Hulhumale’ Court have been temporarily halted following the case filed to Supreme Court, questioning the legitimacy of the Hulhumale’ Court.
