The High Court has annulled Hulhumale’ Court’s decision that the trial of the case against former President Mohamed Nasheed cannot be held at Hulhumale’ Court.
The case was filed to Hulhumale’ Magistrate Court by the Prosecutor General’s (PG) Office, against Nasheed, in relation to the arrest and detention of Chief Judge of Criminal Court, Abdullah Mohamed at the Military training facility in Girifushi island.
The PG had requested Hulhumale’ Court to review its decision that the trial cannot be held at that Court, to which Hulhumale’ Court had replied that its decision cannot be reviewed unless it is annulled by a higher Court.
Hulhumale’ Court cited that it had no jurisdiction over the case, when it returned the case to the PG Office.
PG Office has pressed charges against former President and Commander-in-Chief Mohamed Nasheed, former Defence Minister Thalhath Ibrahim Kaleyfaan, former Chief of Defence Force Moosa Ali Jaleel, Brigadier General Ibrahim Mohamed Didi and Colonel Mohamed Ziyad.
Judge Abdullah Mohamed was arrested on 16 January 2012.
