State prosecution alleges Ahmed Maldhaan Ali’s negligence behind the wheels of the car he was driving led to the death of Fathmath Shiuna, 28, from R. Rasgetheemu in the fatal accident which took place in Hulhumale’ on September 3, 2016.
The accident took place on the street Nirolhu Magu in Hulhumale’ while Shiuna had been out on a drive on a motorcycle with Mohamed Shahid – a lecturer who works at Islamic University of Maldives.
The car which Maldhaan had been driving hit the back of the motorcycle which Shiuna had been on the backseat of.
Shiuna had died a couple of hours later without regaining consciousness, while Shahid was treated for his injuries and later released from the hospital.
While reading the charges against Maldhaan during the hearing held at Criminal Court this Wednesday, January 18, State prosecution alleged that it had been his negligence behind the wheels of the car which led to the accident, and Shiuna’s death.
Maldhaan was charged in reference to Article 112 (a) and Article 112 (b) of Penal Code.
It states that causing the death of a person as a result of negligence was a criminal offense punishable with up to four years in prison.
Maldhaan said he wanted to address the charges against him with legal assistance. And Judge Adam Arif granted a 10-day period during which to hire a defense attorney.
During the hearing, Maldhaan requested for leniency in his detention given he was the “only son my mother has.”
Judge Adam Arif denied the request given the seriousness of the charges against him, ordering that he be kept jailed pending the outcome of the trial.
