The Judge’s Council at the Criminal Court has said that they cannot accept the case of the former President Mohamed Nasheed’s transfer back to prison after he was released to house arrest to serve out the rest of his 13-year prison sentence.
A statement released by the Criminal Court today said that the Judge’s Council also supports the decision by the Court’s Registrar to not accept the case submitted by the President Nasheed’s lawyer, Hisaan Hussain regarding the former president’s transfer back to prison on 23 August around 9:35 p.m.
The Registrar of the Criminal Court has said that the case cannot be accepted under Article 60-B of the Law of Courts.
The Criminal Court said that when they researched the case submitted by lawyer Hisaan, it is clear that President Nasheed was sentenced to 13 years in prison by the court.
And implementing a legally passed down sentence is the responsibility of the Maldives Correctional Services under the Maldivian Law of Prisons and Parole.
Lawyer Hisaan submitted the case claiming that a letter from the Correctional Service states that President Nasheed was transferred to house arrest to carry out the rest of his 13-year sentence.
Commissioner of Prisons, Mohamed Husham has said that no such letter was sent.
