The issue of appointment of a member from the parliament to the Judicial Service Commission (JSC) has been removed from the agenda of tomorrow’s parliament sitting.
The parliament said that follows a request by all political parties represented in the parliament, to postpone this issue.
Three names were nominated for the post of JSC member, but none of them were passed at the parliament sitting on Tuesday. Two-thirds of the parliament must vote in favour of a name for it to be approved as the member appointed by the parliament to JSC.
JSC member appointed by the parliament, Gasim Ibrahim lost his JSC seat when he decided to run for presidency.
According to article 10 of the JSC Act, the seat of a JSC member will become vacant if the member decides to contest for a political position elected under the Constitution or a Law.
JSC is made up of ten members. They are Supreme Court Judge Adam Mohamed, Parliament Speaker Abdullah Shahid, High Court Judge Abdullah Hameed, Criminal Court Judge Abdullah Didi, member appointed to JSC from the public Sheikh Shuaib Abdul Rahman, member appointed to JSC by the president Latheefa Gasim, and Attorney General Aishath Azima Shakoor.
Mohamed Fahmy Hassan, who has been dismissed after he lost his seat at the Civil Service Commission (CSC), continues to attend JSC’s meetings.
The final sitting of the second session of the parliament of 2013 will be held tomorrow at 9:00 am.
