JSC requests to expedite Hulhumale

The Judicial Service Commission (JSC) has asked the High Court to expedite the case filed by former President Mohamed Nasheed requesting to declare illegal the appointment of the bench to Hulhumale’ Court, to preside over the case regarding the unconstitutional arrest of Chief Judge of Criminal Court Abdullah Mohamed.

This was confirmed to Sun Online by JSC Media Official Hassan Zaheen, who said that it is not unusual for the commission to make such a request.

Zaheen said that JSC had also requested the High Court to expedite the case appealed by the commission regarding the voidance by the Civil Court of the commission’s decision to take action against Judge Abdullah.

He said that JSC had requested courts on several occasions in the past, to expedite cases filed or defended by JSC.

At the last session of the trial, JSC raised a procedural issue and said that the bench appointed to Hulhumale’ Court to preside over the case regarding the unconstitutional arrest of Judge Abdullah was based on the counsel of the Supreme Court.

JSC argued that the three judges are educated, experienced and competent.

JSC highlighted that the Supreme Court is the highest power, and a decision by the Supreme Court cannot be contested in the High Court, and so requested the High Court to declare that this case should not have been filed to court in the first place.

The High Court gave Nasheed’s team a period of one month to present a defence to JSC’s claim.

The High Court has ordered the Hulhumale’ Court to suspend the trial until the proceedings in the High Court are concluded.
