The Prosecutor General’s Office announced Wednesday that it will file a review of the High Court’s decision to dismiss its appeal in the 72kg drug trafficking case, citing procedural irregularities in the registration process.
The High Court had dismissed the appeal, filed against the Criminal Court’s acquittal of three men accused of smuggling 72 kilograms of diamorphine aboard the fishing vessel Masjari-2, after the MVR 300 registration fee was not paid within the court’s deadline. The dismissal was signed by High Court Registrar Maryam Hoorushida.
However, the PG Office contends it never received the email instructing payment. While the High Court claims the order was sent on October 5, the PG Office said it received other emails from the court on that day and the next, but none related to the registration fee.
“The decision of the Registrar will be submitted for review, which should be conducted by the High Court itself,” the PG Office stated.
The appeal had challenged the acquittal of Irufan Thagiyyu, Ahmed Naseer (38) of Anbugasdhoshuge, Dh. Maaenboodhoo, and Mohamed Akram (27) of H. Gardenbeauty, Malé. All three were acquitted by Judge Ibrahim Ihusaan. Charges against seven other suspects were previously withdrawn due to insufficient evidence.
