Assistant Police Commissioner Mohamed Jamsheed and Assistant Police Commissioner Ahmed Mohamed, who were dismissed following the police board's decision to terminate several police officers, have been restored to their positions after a period of three years.
Police informed Sun on Wednesday that Jamsheed and Ahmed Mohamed were reinstated to the rank of Assistant Commissioner following a High Court judgment.
The Police Board had decided to remove senior police officers from their posts on October 10, 2022. Five officers involved in the case filed a civil suit, and the verdict was initially set in December 21 of that year. The prosecution then filed the case in the High Court.
The police board's decision encompassed the dismissal of seven officers. They are:
Superintendent Mohamed Dawood
Assistant Commissioner Faruhadh Fikury
Chief Superintendent Ahmed Shuhaadh
Assistant Commissioner Mohamed Jamsheed
Assistant Commissioner Ahmed Mohamed
Superintendent Ismail Shameem
Chief Superintendent Abdulla Shareef
Of these, Faruhadh Fikury and Ahmed Shuhaadh were not involved in the civil suit.
The case was dismissed on July 23 this year after more than two years in the High Court. When the case was dismissed, the High Court had earlier ordered non-compliance with the civil court's decision.
The High Court dismissed the case on the grounds that the prosecution was abusing the judicial system.
The five officers had submitted the case alleging wrongful dismissal by the Police Board and seeking to restore their infringed administrative and constitutional rights. The Civil Court, which heard the case behind closed doors, decided in December last year that the officers were dismissed wrongfully.
Therefore, the notice to dismiss some officers was found to be in violation of Article 3 of the Police Service Act. The judgment of the Civil Court ordered the quashing of the decision as it was in violation of the Act.
