The Criminal Court has sentenced Mohamed Samah of Suvaasaage, K. Kaashidhoo to death, after finding him guilty of the murder of Police Officer Adam Haleem of Kethi, K. Kaashidhoo.
Reading the verdict at the trial today, the judge said that since the court found Samah guilty of murder, relevant authorities are notified and ordered to execute him in accordance with Islamic principles.
The judge said that the three heirs of Adam Haleem, namely his father, mother and wife had asked for the death penalty. He said that because the fourth heir is Adam Haleem’s child who is less than one year old, the rules described in the doctrines of Hanafi and Maliki must be referred to when making a decision on the child’s behalf.
The Hanafi school of thought gives the judge the authority to make this decision on behalf of a child who has not attained adulthood, while Maliki says that this authority could be given to the child’s heirs.
The judge referred to the confession statement and said that Samah voluntarily attacked Adam Haleem with a knife with a 4-inch blade, and that Samah was intoxicated when he committed this crime.
