Judges’ Appeal Chamber for prevailing year constituted

Judical Service Commission’s (JSC) Judges’ Appeal Chamber for the prevailing year has been constituted.

The Judges Appeal Chamber probes appeals of all decisions taken by JSC excluding decisions to initiate dismissal of a judge by submission to the parliament. Appointments are made for the chamber annually.

The Chamber comprises of three judges; a judge from the Supreme Court that is not the Chief Justice or the representative member of JSC from the court; a judge from High Court that is not the representative member of JSC from the court and a judge from a superior court that is not a member of JSC.

As per the Judicial Service Commission Act – all decisions by JSC following their investigations into complaints submitted regarding judges excluding decisions to initiate dismissal of a judge by submission to the parliament may be appealed to the Judges Appeal Chambers within a 10-day period from the date of the decision.

This year’s Judges Appeal Chamber comprises of Supreme Court Justice Ali Rasheed Hussain, High Court Judge Mohamed Faisal and Juvenile Court Judge Ahmed Shareef.

Last year’s Judges Appeal Chamber comprised of Supreme Court Justice Husnu Al Suood, Drug Court Justice Muhthaaz Fahumy and High Court Justice Fathimath Faruheeza.

The Judicial Service Commission Act’s states that decisions by JSC to initiate dismissal of a judge by submission to the parliament cannot be appealed at all.

The Judges Appeal Chamber was formed by the second amendment to the legislature.
