The Supreme Court has ordered High Court to defer action on the case appealed by former President Mohamed Nasheed.
An official of Supreme Court said today that Supreme Court issued this order because the appealed case includes a procedural point concerning the legitimacy of the Hulhumale’ Court.
“A case questioning the legitimacy of the Hulhumale’ Court has been filed to Supreme Court. At the same time, the case appealed to High Court includes a procedural point concerning the legitimacy of the Hulhumale’ Court. Thus Supreme Court ordered High Court yesterday to defer action on the appealed case until the Supreme Court makes a decision,” he said.
The case on the legitimacy of the Hulhumale’ Court was filed to Civil Court, about one year ago, by lawyer Ismail Visham. The Judicial Service Commission (JSC) decided that this case was not within the jurisdiction of the Civil Court, and requested Supreme Court to look into it.
The Supreme Court failed to act on this request, prompting JSC to file the request again some weeks ago, following which the Supreme Court has now commenced proceedings on the case.
