Supreme Court orders Hulhumale

The Supreme Court has yesterday ordered Hulhumale’ Magistrate Court to resume work as per normal.

Supreme Court said that despite this order, the trial of former President Mohamed Nasheed will remain suspended as per High Court’s Order.

All work at Hulhumale’ Court was halted last Monday in line with article 143 (d) of the Constitution on Jurisdiction of the Courts - which says that lower courts shall follow the decisions of a higher court - following a High Court temporary order to suspend Nasheed’s trial.

The High Court temporary order detailed that continuing with the trial before a decision is made on the case appealed by Nasheed to High Court might obstruct ensuring Nasheed’s rights, and result in damage being caused to Nasheed.

A case filed by lawyer Ismail Visham to Civil Court about a year ago, questioning the legitimacy of Hulhumale’ Court, is currently in progress at Supreme Court.
