Attorney General (AG) Aishath Azima Shakoor has said that Hulhumale’ Court should not be allowed to hold any trial, following the High Court order to temporarily halt the trial against former President Mohamed Nasheed at Hulhumale’ Court.
Hulhumale’ Court today suspended all trials pertaining to the arrest of Chief Judge of Criminal Court Abdullah Mohamed, following a High Court order to temporarily halt the trial against Nasheed until a decision is made on the case appealed to High Court by Nasheed.
Speaking to Sun Online today, Azima Shakoor highlighted that High Court’s temporary order detailed that continuing with the trial before High Court makes a decision on the case appealed by Nasheed, might obstruct ensuring Nasheed’s rights.
Azima said that halting one trial at a Court due to questions raised about the Court’s legitimacy, means that all trials at the Court must be halted – as failure to do so would obstruct ensuring the rights of all defendants.
“My opinion, therefore, is that everyone must be treated fairly. If Nasheed’s trial cannot be continued, trials against other people should also not be continued, because otherwise, their rights could also be denied,” she said.
The lawyer of AG Office also said at the hearing at High Court today that the fair decision would be to temporarily halt all trials at Hulhumale’ Court.
Member of Nasheed’s legal team, Hisaan Hussain also said today that it cannot be justified to hold other trials at Hulhumale’ Court while questions are being raised about the Court’s legitimacy.
The Judicial Service Commission (JSC) filed a case today to Supreme Court, requesting it to determine the legitimacy of Hulhumale’ Court.
