ACC can halt Border Control System project: High Court

The High Court has ruled that the Anti-Corruption Commission (ACC) has the authority to order to halt the Border Control System project.

Meanwhile, the Supreme Court ruled some weeks ago that the ACC does not have the authority to order disruption of any government projects.

The High Court bench which made this decision comprised of Chief Judge Ahmed Shareef Ali, Judge Yoosuf Hussain and Judge Dr Azmiralda Zahir.

This decision comes following the case appealed by ACC, subsequent to Civil Court’s ruling that ACC does not have the authority to order to halt the Border Control System project.

The High Court ruling details that the letter sent by ACC to Immigration Department dated 24 January, ordering to halt the Border Control System project, was in line with article 25(a, 3) of the ACC Act.

It also states that corruption prevention laws and article 199(b) of the Constitution gives the ACC full authority to do the necessary to prevent and combat corruption.

Thus, the High Court annulled the Civil Court’s ruling that ACC does not have the authority to order to halt the Border Control System project, and ruled that the Immigration Department must comply with ACC’s Order to halt the project.
