Dismissal of Nasheed

The Prosecutor General’s (PG) Office has appealed to High Court the dismissal by Hulhumale’ Magistrate Court, of the case against former President Mohamed Nasheed regarding the arrest of the Chief Judge of Criminal Court Abdullah Mohamed.

In addition to Nasheed, the case alleges former Defence Minister Thalhath Ibrahim Kaleyfaan, former Chief of Defence Force Moosa Ali Jaleel, Brigadier General Ibrahim Mohamed Didi and Colonel Mohamed Ziyad of involvement in this crime.

The PG Office said that the case was appealed to High Court today.

Hulhumale’ Magistrate Court had dismissed the case citing that it had no jurisdiction over the case. The PG Office’s request to review this decision was also denied.

The charges against those involved accuse them of having committed a crime under article 81 of the Penal Code, which stipulates that it is a crime to detain an innocent person.

The penalty for this crime is imprisonment for maximum three years, or be fined for not more than MVR2,000.
