A member of the Judicial Service Commission (JSC) has said that the Civil Court judge, Judge Mariyam Nihaayath was suspended for passing two sentences in one case.
The JSC member who wishes to remain anonymous told Sun Media that in a civil suit concerning money, Judge Nihaayath passed a sentence saying that the case cannot continue after the plaintiff failed to show up in court. And the sentence was also uploaded to the website of the Civil Court.
But later, Judge Nihaayath passed a sentence ordering the defendant to play the sun to the plaintiff according to the JSC member.
“After sentencing that the case cannot continue, it can only be continued after it has been resubmitted. No sentence can be passed before resubmission. If so that is two sentences for on case.” The JSC member said.
Jusge Nihaayath has been suspended until a decision has been made by the JSC.
JSC has said that Judge Nihaayath was suspended after reviewing her statement to the investigation, the type of the complaint and the information received by the investigation.
