A legal team has been assigned to investigate the removal of Dr Ibrahim Didi and Alhan Fahmy from the posts of MDP President and Vice President, subsequent to the decision that several legal issues are involved in removing them from their posts.
Elections Commission Vice President Ahmed Fayaz said that the team should complete their investigation next week and present a report to the commission.
Fayaz said that discussions held by the commission today revealed that Didi and Alhan were removed against the MDP basic regulations registered at the commission. However only after investigation by the legal team can it be determined whether the decision made by the MDP National Congress was according to the party’s basic rules, or not.
“MDP says that the removal was conducted according to regulations. But the two individuals are saying that they were removed against regulations. So we have to look into the validity of what was done from a legal perspective. If the decision was made after they made changes to the basic rules but failed to inform the commission, then their decision won’t change. But they must present the documents to the commission. But there’s also no penalty if they don’t present the documents,” Fayaz said.
Didi has submitted the case his and Alhan’s removal to Elections Commission, while Alhan is working on filing the case to court.
