Case filed to High Court to annul amendment to Courts Act

A case has been filed to High Court to annul the amendment to the Courts Act passed by the parliament, to reduce the Supreme Court bench.

The case was filed by lawyers Shaheen Hameed, Hassan Maaz Shareef, and Mohamed Faisal.

Speaking to Sun Online after filing the case to the court, Shaheen Hameed said that the case requests to annul the amendment to the Courts Act, as it is a violation of the Constitution.

Shaheen said that they have also requested for an injunction upon the parliament and all relevant authorities, to delay the implementation of the amendment, and to halt all efforts related to the removal of the judges until the court issues its verdict on this case.

He noted that the Constitution prescribes the separation of the three powers, and said that it is a procedural issue when one power attempts to interfere with the matters of another power, such as the attempt to remove judges.

He also said that it was a violation of the Constitution to notify the Judicial Service Commission (JSC) to remove two particular judges of the Supreme Court based on the assumption that they were incapable, without any investigation or evidence.
