Civil Court has decided to proceed with Feydhoo MP Alhan Fahmy’s case requesting the court to annul Maldivian Democratic Party’s (MDP) parliamentary primary election for Feydhoo constituency. The ruling follows a move by MDP, seeking a ruling from the court to state that the case cannot be processed.
Lawyer representing MDP Abdulla Shair argued in court yesterday that MP Alhan did not submit the issue to the party relevant internal committee and therefore, had not fulfilled MDP’s Basic Regulation as he filed the case in court.
Civil Court, however, ruled today that rejecting the case based on MDP’s claim would be a violation of Article 42 of the Constitution, which states that everyone is entitled to a fair and public hearing.
