No-confidence motion against JSC President rejected

The Judicial Service Commission (JSC) has said that it is not possible to table the no-confidence motion against its president, as this motion was filed in violation of the JSC Act.

Sheikh Shuaib Abdul Rahman, who filed the case of no-confidence, was informed by President of JSC Adam Mohamed that the case cannot be put on the agenda of the JSC meeting.

The letter sent by Adam Mohamed, who also acts as a judge of the Supreme Court, to Shuaib states that Shuaib’s proposal is a violation of article 10 of the JSC Act created under articles 157 (b) and 157 (c) of the Constitution, because this article does not mention the removal of the commission’s presidents through a vote of no-confidence by commission members.

The JSC Act does not state that the president and vice president of the commission, who are elected through a vote by the ten members of the commission, can be removed through a vote of no-confidence by commission members.

Adam Mohamed said in his letter that according to article 10 (b) of the JSC Act, the post of the president or vice president of the commission shall be deemed vacant under the same circumstances in which a member’s post becomes vacant, or if the president or the vice president resigns from the post.

Shuaib told Sun after filing the no-confidence motion against Adam Mohamed that the JSC Regulation allows the removal of the commission’s president through a vote of no-confidence. He said that this motion was filed because Adam Mohamed has failed to keep his actions impartial and just when carrying out his responsibilities as the president of the commission.
