Civil Court quashes previous ruling to compensate man for K-Park apartment

The Civil Court on Wednesday overturned an earlier ruling issued by the same court ordering for a man to be compensated for the money he paid for an apartment at the K-Park Residence - a condominium under development in Hulhumale’.

On October 24, 2022, the Civil Court ordered the condominium’s developer, Hanbo Company, to pay MVR 2.9 million and USD 20,000 to Rafeeuddin Hassan, a native of Addu City’s Hithadhoo. The ruling was issued without Hanbo’s legal representatives present.

Hanbo filed a suit with the court asking for the ruling to be overturned, citing multiple irregularities, one of which was that Rafeeuddin’s lawyer in the court case was the same person who notarized the agreement signed between him and Hanbo on August 12, 2021.

Hanbo argued that this should have been grounds to bar him from the court case.

The Civil Court decided in favor of Hanbo on Wednesday, ruling that Rafeeuddin’s lawyer could not act as his legal representative in the case, and that the original lawsuit, which was signed by the lawyer in question, is therefore invalid.

The judgement was delivered by Judge Adam Zalif.

The K-Park Residences was the subject of a fraud investigation by the police. Hassan Mamdhooh (Manday), the former minority shareholder of Hanbo, and his acquaintance Jaishan Saeed are on trial for over 200 charges of over fraud in the sale of apartments from K-Park Residence.
